Bankruptcy
Our bankruptcy lawyers represent a variety of commercial finance clients, including banks and traditional financial institutions, other secured lenders, landlords, creditors’ committees, and bankruptcy trustees in bankruptcy matters. Our team also advised clients across a broad range of trades and industries, assisting insurance companies, utility companies, real estate developers, equipment leasing and finance companies, and asset-based lenders in bankruptcy cases. Our lawyers have been involved in bankruptcy cases in which the debtors range from manufacturing operations, real estate development projects, dealership and franchisee operations, and grocery store chains.
In addition to general bankruptcy representation, we often assist clients in adversary proceedings, including defending our clients against preference and fraudulent conveyance claims. Our team is also well versed with the business and legal issues that can arise in business transactions and have the transactional experience to develop business solutions for problematic and challenging bankruptcy matters. As such, we frequently represent parties in asset sales and similar transactions within the bankruptcy case.
Kerk Spong currently serves as the standing Chapter 12 (Agricultural) Trustee and Subchapter V (Small Business) Trustee. Our attorneys have also served or currently serve as an appointed Liquidating Trustee, Chapter 11 Trustee or Fee Examiner.
